Challenge

Delayed Business Interruption Claim

A retail business suffered losses following a flood event. Their business interruption claim had been under assessment by the insurer for eleven months with no substantive update. The business owner was uncertain whether the claim was being assessed correctly under the policy.

Our Approach

We reviewed the policy and the insurer's correspondence, identified that the insurer had applied the wrong indemnity period definition, and prepared a formal written challenge. We also requested a full claims file under the applicable regulatory guidelines.

Outcome

The insurer acknowledged the error and issued a revised assessment. Settlement was concluded within eight weeks of our engagement. The client received a settlement exceeding the initial offer by approximately 40%.

Challenge

Policy Rescission in Fire Loss Matter

Our Approach

We conducted a detailed analysis of the rescission notice, the pre-inception disclosure documents, and the insurer's compliance with the procedural requirements under the Financial Services Act 2013. We prepared an arbitration submission challenging both the factual basis and the regulatory compliance of the rescission.

Outcome

The arbitration panel found in favour of the policyholder on both grounds. The rescission was set aside and the insurer was directed to assess the fire claim on its merits. The engagement involved FMB referral followed by formal arbitration proceedings.
